中国民主党(旧金山党部)倡议书 要求军队国家化,反对党卫军体制

值此中共建军九十九周年之际,我们,中国民主党(旧金山党部)联合中国民主教育基金会向所有关心中国前途、民族命运与人民福祉的人士郑重发出倡议。

回顾近现代世界历史,凡是走向稳定、繁荣与法治的国家,无不确立了一个基本原则:军队属于国家,而不属于任何政党或个人。军队的唯一合法性来源,应当是宪法与法律,而非政治组织的意志。军队的职责,是保卫国家安全、维护社会稳定、守护人民生命财产,而不是参与政治斗争,更不应成为任何政治集团维持统治的工具。

然而,长期以来,中共坚持“党指挥枪”的政治原则,将国家武装力量置于单一政党之下,使军队在制度上与国家宪政结构相分离。这种体制在本质上导致国家军队政党化,使其难以真正代表全体国民利益,也在客观上造成军人与社会之间隔阂与紧张关系。历史经验一再表明,当军队被绑定于特定政治力量时,国家治理将失去中立性与公信力,社会也难以建立真正的法治秩序。

我们必须清醒认识到,现代国家的军队不应是“党军”,更不应是任何形式的“党卫军”。军队一旦脱离国家宪法的约束,便可能在政治化路径中偏离其本职使命,从而损害国家长远利益与人民根本权益。真正强大的国家,不在于军队服务于某一政权,而在于军队服务于全体人民与国家整体利益。

基于此,我们郑重呼吁:

一、推动军队国家化,使军队回归国家宪法体系之下,成为真正意义上的国家武装力量。 

二、确立军队忠诚对象的唯一性,即忠于国家、忠于人民,而非任何政党或个人。

 三、军队里的每一位官兵应该站在广大人民群众和世界上一切爱好自由的人们一边,打倒中共反人类独裁者!

四、军队要为人民服务!军队里的每一位官兵有权拒绝执行一切不合法,反人类的命令 。

我们相信,真正的军人荣誉,不仅来自服从命令,更来自对国家、人民与正义的忠诚。军人的誓言,应当建立在保护无辜、维护和平与遵守法律的基础之上,而非任何违背人类基本良知的政治要求。

国家属于人民,军队属于国家,这是现代文明社会不可动摇的基本原则。人民不是任何政治力量的附属,而是国家真正的主人。军队的存在,是为了守护人民,而不是凌驾于人民之上。

我们坚信,一个真正走向现代化、法治化与宪政化的中国,必将建立起国家化、专业化、非政治化的国防体系。在这样的体系中,军人与人民之间将不再是隔阂与对立,而是相互信任、彼此守护的共同体。

让我们共同努力并持续推动这一历史性转变: 军队属于国家,属于人民;军队国家化,是中国迈向民主、法治与宪政不可或缺的重要一步。

Proposal by the China Democracy Party (San Francisco Chapter)Calling for the Nationalization of the Armed Forces and Opposing the Party-Controlled Military System

On the occasion of the 99th anniversary of the founding of the CCP’s military, we, the China Democracy Party (San Francisco Chapter), together with the Chinese Democracy Education Foundation, issue this solemn proposal to all individuals who care about China’s future, the destiny of the nation, and the well-being of the people.

Reviewing modern and contemporary world history, every nation that has moved toward stability, prosperity, and the rule of law has established a fundamental principle: the military belongs to the nation, not to any political party or individual. The sole source of legitimacy for the armed forces should be the constitution and the law, not the will of a political organization. The duty of the military is to safeguard national security, maintain social stability, and protect the lives and property of the people, rather than participating in political struggles, let alone serving as a tool for any political group to maintain its rule.

However, for a long time, the CCP has adhered to the political principle that “the Party commands the gun,” placing the nation’s armed forces under a single political party and institutionally separating the military from the national constitutional structure. In essence, this system leads to the party-politicization of the national military, making it difficult for the armed forces to genuinely represent the interests of all citizens, while objectively causing alienation and tension between servicemen and society. Historical experience has shown time and again that when the military is bound to a specific political force, national governance loses its neutrality and public credibility, and society finds it difficult to establish a true order under the rule of law.

We must clearly recognize that the military of a modern state should not be a “party army,” nor should it be any form of a “party-guard force.” Once the military is freed from the constraints of the national constitution, it may deviate from its primary mission along a politicized path, thereby harming the long-term interests of the nation and the fundamental rights and interests of the people. A genuinely powerful nation does not rely on a military that serves a specific regime, but on a military that serves all the people and the overall interests of the nation.

Based on this, we solemnly appeal:

1. Promote the nationalization of the armed forces, bringing the military back under the framework of the national constitution so that it becomes a true armed force of the state.

2. Establish the singularity of the military’s object of loyalty—that is, loyalty to the nation and loyalty to the people, rather than to any political party or individual.

3. Every officer and soldier in the military should stand with the broad masses of the people and all freedom-loving people around the world, to overthrow the CCP’s anti-humanity dictatorial rulers!

4. The military must serve the people! Every officer and soldier in the military has the right to refuse to execute any illegal or anti-humanitarian orders.

We believe that true military honor comes not only from obeying orders, but even more from loyalty to the nation, the people, and justice. A soldier’s oath should be built upon the foundation of protecting the innocent, safeguarding peace, and abiding by the law, rather than fulfilling any political demands that violate basic human conscience.

The nation belongs to the people, and the military belongs to the nation; this is an unshakable fundamental principle of modern civilized society. The people are not subordinates of any political force, but the true masters of the nation. The existence of the military is meant to protect the people, not to stand above them.

We firmly believe that a China truly moving toward modernization, the rule of law, and constitutionalism will inevitably establish a nationalized, professionalized, and non-political national defense system. In such a system, there will no longer be alienation or opposition between soldiers and the public, but rather a community of mutual trust and mutual protection.

Let us work together to continuously promote this historical transformation: the military belongs to the nation and to the people; the nationalization of the armed forces is an indispensable and crucial step for China toward democracy, the rule of law, and constitutionalism.
